Jammu Kashmir High Court directed for release of nine vehicles which were seized for carrying minor mineral material extracted from River Tawi in violation of the orders of the court.
The Division Bench of Acting Chief Justice Rajesh Bindal and Justice Sanjay Dhar while hearing the application seeking release of seized vehicles, directed for their release subject to costs of Rs 50, 000 against each vehicle.
The Registry has reported that these vehicles are first time violator and no similar applications were filed seeking release of the same. Court after considering the plea and the consent of the parties, ordered release of these vehicles in favour of registered owners.
Court while ordering release of these vehicles imposed costs of Rs 50, 000 on each vehicle and directed for depositing before the Registrar Judicial Jammu with an undertaking that the aforesaid vehicles has been seized for the first time for alleged violation.
Owners have also to undertaken that they will not use their vehicles in future for such kind of violation. “In case the vehicle is seized again for such kind of violation, this court may take a serious note of the matter and may not be inclined to release the vehicle”, reads the order
Court has also made it clear the jurisdictional court having received the challan shall decide the same on merits and the amount now ordered to be deposited would be refunded in case the applicants are acquitted of the charge
