Jammu, Jan 5:Lot of officers were retired as deadwoods but in actual they were not so, and that is why Governments lost such kind of cases up to Apex Court and causing loss to govt exchequer to the tune of crore by way of litigation charges & in real such Officers, who reccomended/approved the cases under Art 226 are in real dead woods because it openly speaks of their lack of knowledge by which such orders were passed, should be removed from services.
LG can check, how Revenue bosses from top to bottom are harssing innocents over a settelled issue in WPPIL 19/2013, 20/2014 followed by CPPIL 08/2016 by which stay has been vacated, JDA/Housing Department bosses are harassing by not framing Zonal Plans for genuine sanction of building plans in violation of Acts & other bosses in different genuine issues & how Govt can rely on such bosses that if they are not doing justice with their duties assigned for which they are heavily paid over simple issues, how they will do justice with employees over such a serious issue of one’s life.
o, it is very necessary to provide the refreshing training to the bosses over the rules framed by Govt/supreme court guidelines issued over Article 226(2) so that innocents can be saved and only Corrupts and deadwood face actions.
It is also a issue to be looked into by LG by punishing Officers of the old regime up to 2003, who approved illegal orders under Art 226(2), which all were quashed by different courts, which clealy speaks of so called competance of Officer of J&K.
